RELATING TO FEES FOR CERTIFICATE OF COMPLIANCE

WHEREAS, in order to provide compliance with existing building ordinances, the City of Seneca Gardens, Kentucky (the “City”) strives to maintain a plan for bringing any new structure or addition on a residence within the City into compliance with existing ordinances (the “Certificate of Compliance Project”);

WHEREAS, the City has reviewed the existing Certificate of Compliance Project and found that the costs and associated with review and consideration of each new project submitted for approval under the Certificate of Compliance Project have increased, and desires to raise the existing fees charged under the Certificate of Compliance Project;

WHEREAS, the Commission further desires to raise the application fee to be charged to each resident that submits new projects to the Commission under the Certificate of Compliance Project from $50.00 to $150.00 (the Application Fee”) and that the compliance fee be raised from $50.00 to $350.00 (the “Compliance Fee”);

WHEREAS, the Commission has reviewed and found that maintaining the Certificate of Compliance Project and that raising the fees associated with the Certificate of Compliance Project is necessary and proper and in the best interests of the City and its citizens; and

WHEREAS, the Commission further desires to comply with Chapter 91A of the Kentucky Revised Statutes (“KRS”) by enacting an Ordinance for the raising of the Application Fee and the Compliance Fee for the Certificate of Compliance Project in compliance with the KRS.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF SENECA GARDENS, KENTUCKY, that:

The Fee for the Certificate of Compliance Project shall be $350.00. The Application Fee for the Certificate of Compliance shall be $150.00. This ordinance shall take effect after its passage and approval of the Commission of the City and upon publication.

Adopted and effective, this 17^th day of February, 2003.
